THIS IS A VACATION RENTAL AGREEMENT. YOUR SUBMISSION OF THIS AGREEMENT, OR PAYMENT OF MONEY OR ARRIVAL TO THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A SHORT TERM VACATION RENTAL. THIS AGREEMENT IS NOT INTENDED TO CREATE AN ESTATE FOR YEARS OR TRANSFER ANY OWNERSHIP IN THE PROPERTY TO THE TENANT/GUEST NOR TO ANY OF THE TENANTS GUESTS.
1. Premises.

Property Description: Physical address of Unit “4 Oaks” is at 705 W Conyers Street, Saint Marys, Georgia 31558 located inside the upstairs portion of the accessory building at this address. "4 Oaks" shares a driveway with the property owners. It is necessary to climb 17 steps to enter the unit. Guests also have access to a small fenced in yard with a firepit. Entrance to the yard is accessible using the gate behind the stairs of the unit. Inside the unit is an open studio style room with 1 King sized bed, a reclining leather sofa, projector with WIFI streaming capabilities, freestanding range, refrigerator/freezer, kitchen sink, dishwasher, toaster oven, coffee maker, utensils, pots, pans, popcorn maker, table with 2 chairs, 2 barstools, washing machine, clothes dryer, tile shower, toilet, sink, iron, hangers, 1 twin size rollaway bed, 1 full sized loft bed for ages 10 and up with a total weight capacity of less than 225 pounds.
Door code to be provided within 24 hours of check-in.
Occupancy Limit: 3 people
2. Term.
BEGINS in accordance with your reservation confirmation date at 2 PM Eastern Time
ENDS in accordance with your reservation confirmation date at 10 AM Eastern Time
3. Tenant Representation.
Tenant represents and warrants that Tenant is at least 18 years old and that Tenant will occupy the Premises during the Term of the tenancy created hereunder. Minors under the of 18 should not be left unattended inside the Premises.
4. Rent, Payment Procedures and Financial Terms
Payment Procedures:
Tenant agrees to pay rent for the premises in accordance with AirBNB’s terms, conditions and amounts. For clarification on terms, conditions or fees, please contact the relevant booking site directly.
If damages or loss occur, Tenant will be charged actual costs to repair or replace damage plus a $25/hour fee to schedule and coordinate repairs to the damages caused by the tenant, tenant’s guests and/or pets.
AirBNB will collect applicable state, county and/or occupancy taxes then remit to the corresponding agencies. AirBNB and other booking sites collect payment on behalf of the landlord and tenant payments are disbursed to the landlord after check-in. Landlord does not hold tenant money in advance of the tenant rental term.
5. Tenant Duties.
Tenant agrees to comply with all obligations imposed by this Vacation Rental Agreement with respect to maintenance of the Premises, including but not limited to:
(i) keeping the Premises as clean and safe as the conditions of the Premises permit and causing no unsafe or unsanitary conditions in the common areas and remainder of the Premises that Tenant uses;
(ii) not deliberately or negligently destroy, deface, damage, or remove any part of the Premises or knowingly permit any person to do so;
(iii) notifying Agent in writing of the need of replacement of or repairs to a smoke detector, and replacing the batteries as needed during the tenancy; and
(iiii) Tenant agrees not to use the Premises for any activity or purpose that violates any criminal law or governmental regulation and may use the Premises for residential purposes only. Tenant’s breach of any duty contained in this paragraph shall be considered material, and shall result in the termination of Tenant’s tenancy.
6. Occupancy Limits.
Unless otherwise stated, occupancy of the Premises shall be limited to three people. Bedding arrangements in the Premises are portrayed only to illustrate possible sleeping arrangements and may not be taken as a representation of permitted occupancy. Tenant agrees to be responsible for ensuring that maximum permitted occupancy of the Premises is not exceeded during the term of this Agreement, and should contact landlord with any questions regarding permitted occupancy of the Premises. No parties allowed.
7. Landlord Duties.
Landlord is required to provide the Premises in a fit and habitable condition. If at the time Tenant is to begin occupancy of the Premises, the Premises are not in a fit and habitable condition and Landlord cannot substitute a reasonably comparable property in such condition, Landlord, shall recommend that the Tenant initiate a refund request via AirBNB.
8. Cancellation.
Full refund for cancellations up to 30 days before check-in. If booked fewer than 30 days before check-in, full refund for cancellations made within 48 hours of booking and at least 14 days before check-in. After that, 50% refund up to 7 days before check-in. No refund after that.
9. Eviction.
Tenant may be evicted if:
Tenant:
(i) holds over in possession after Tenant’s tenancy has expired;
(ii) commits a material breach of any provision of this Agreement (including any addendum hereto) that according to its terms would result in the termination of Tenant’s tenancy;
(iii) fails to pay rent as required by this Agreement; or
(iv) has obtained possession of the Premises by fraud or misrepresentation.
10. Indemnification and Hold Harmless; Right of Entry; Assignment.
Tenant agrees to indemnify and hold harmless Landlord and its affiliates from and against any liability for personal injury or property damage sustained by any person (including Tenant’s guests) as a result of any cause, unless caused by the negligent or willful act of Landlord. The Property Manager, Owners, Landlord and its affiliates will not be responsible for damage to the Renters personal property while occupying the property. Tenant agrees that Landlord, the owner(s) or their respective representatives may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvements thereto as Landlord or owner may deem appropriate, or to show the Premises to prospective purchasers or tenants. A minimum of 4 hours notice will be given unless otherwise agreed upon by the tenant and landlord. Tenant shall not assign this Agreement or sublet the Premises in whole or part.
11. Pets.
One (1) well behaved dog may be permitted on the property with a paid non refundable pet fee of $75. Dog must be up to date on vaccinations and flea/tick medicine. Dog must be crated when it cannot be observed. Please note, it is important to keep a close eye on your dog during the entire duration of your stay. Although the backyard is fenced, do not leave your dog unattended in the yard or on the premises. Damages resulting from the dog(s) will be billed based on the cost of repairs. Tenant security deposit may be applied to actual damages caused by the tenant or pet on the premises during the time of occupancy. Unless otherwise specifically permitted in this Agreement (including any addendum hereto), no more than one dog shall be allowed on the Premises. Tenant’s breach of this provision shall be considered material, and shall result in the termination of Tenant’s tenancy.
12. Governing Law; Venue.
The parties agree that this Agreement shall be governed by and construed in accordance with the laws of the State of GEORGIA, and that in the event of a dispute, any legal action may only be instituted in the county where the Property is located (CAMDEN COUNTY).
13. HOUSE RULES ADDENDA
a. NO SMOKING ALLOWED INSIDE. Costs to clean and remove odors will be deducted from the security deposit if the unit smells like cigar or cigarette smoke. Be a responsible smoker by properly disposing of butts and ashes in a noncombustible container. Remove all cigarette butts, cigar remnants and ashes from the exterior premises.
b. Unit “MAY NOT” be equipped with private toiletries like bar soap, toothpaste or toothbrushes. Bring these items with you. Shampoo, conditioner and body wash are available for use.
c. Unit “MAY” be equipped with: Bedding, pillows, towels, pots & pans, dishes, toilet paper, paper towels, and garbage bags. These items are provided for the common 3-night stay. If you run out of anything, you will need to buy more to finish out your stay.
d. At Departure: Please be honest with us if anything gets broken or damaged during your stay and tell us about it so we are not surprised when the unit is inspected and cleaned. Please walk around the grounds and pick up any trash and/or cigarette butts that have occurred during your stay. Prior to your departure, the unit must be left in a cleaned up manner. Guests are responsible to clean dishes, place trash in the exterior garbage bin, unplug the coffee maker, flush toilet and place used towels in the laundry basket.
e. Electrical Systems & Furniture:
Do not move any of the furniture during your stay.
Do not disconnect or change the wiring for any of the internet, projector, exterior cameras or any electrical equipment. Projector and other electronics are to be controlled with the provided remote controls.
f. Toilets/Sinks/Tubs/Showers
Plumbing system is fragile and cannot handle feminine hygiene items, large amounts of toilet paper or anything other than bodily waste. Please perform a courtesy flush in the middle of the toilet sitting process if a heavier than normal load is expected. Do not put anything down the drains aside from minimal amounts of soap used for cleaning bodies or dishes. In the event of a clogged toilet that cannot be unplugged with a plunger, contact us immediately for resolution.
g. Parking
Maximum of 2 vehicles allowed. Please park ALL vehicles on the driveway of the property in front of the stairs leading to the unit. The parking location will be illustrated in our Welcome Guide.
h. Outdoor Fire Pit
Fire pit is not equipped with firewood. You will need to bring firewood with you or you can buy a bundle at most gas stations or stores.
1. All outside fires must be in the designated fire pit container.
2. Make sure that all fires are out prior to leaving the property or going inside the unit. Do not leave the fire unattended.
3. Do not use the fire pit when conditions are hazardous (windy or under a fire ban).
4. Do not cut down trees, plants, or shrubs on the property for use in the fire pit.
5. Burn only wood in the fire pit.
It is unlawful in Georgia to burn man made materials such as tires, shingles, plastics, lumber, or household garbage, even in a burn barrel.
i. Power Outages
Power outages or brown outs are possible. Landlord is not responsible for food or any other losses due to this occurrence. Power is typically restored within a few hours by Georgia Power.
j. Loft Bed
Use of the loft bed is limited to individuals greater than 10 years old weighing less than 250 pounds who are comfortable climbing ladders and who are not fearful of heights. Please refrain from unnecessary use of the ladder. Do not jump on or from the loft bed or ladder. A twin rollaway bed and a king size bed are available to accommodate an occupancy limit of 3 people, without the use of the loft bed.
k. Stairs
It is necessary to climb 17 stairs to reach the unit. Please use caution when using the stairs. Stairs may be slippery when wet. Use the handrail when going up and down the stairs. Make sure to give everyone in your group a copy of this rental agreement so they are informed of rules and information pertaining to your stay.
Tenant agrees that Tenant has received and read any such addenda, and that they shall constitute an integral part of this Agreement.
14. Use of Electronic Means; Notice.
The parties agree that electronic means may be used to sign this Agreement or to make any modifications the parties may agree to, and that any written notice, communication or documents may be transmitted electronically to any email address, cell phone number or fax number used by the parties to communicate during the course of this Agreement. Any notices required or authorized to be given hereunder or pursuant to applicable law may also be mailed to Tenant’s address or hand delivered to the Tenant at the address of the Premises and to Landlord at the Landlord’s address.
15. Rights Reserved
Landlord reserves the right to offer alternative accommodations or a refund without legal or monetary ramifications to the Landlords.
1. We do not issue refunds for any condition beyond our control, such as power outages, city water or plumbing system breakdowns, streaming provider outages, WIFI or internet black outs, appliance malfunctions, and the like; and in no event will we issue a refund for a problem we had no opportunity to resolve.
2. We maintain our premises in the best possible operating condition and, if a problem should occur, we will make every effort to rectify the situation.
3. If tenant decides to leave earlier than their scheduled departure date, there is no refund for the time that the tenant or tenant’s guests were physically present at the property.
4. We do not issue refunds for cleaning fees. Please report any problem with the cleaning immediately and we will send someone to inspect and, if necessary, correct any deficiencies. Under no circumstances will we issue any cleaning fee refund if we do not have an opportunity to inspect.
5. Guests acknowledge that there will be no refund for early check out or delayed check in.
6. In the event the tenant is dissatisfied, we will provide our best attempts to resolve the problem as soon as practically possible.
